Cherie Lincoln appeals from the trial courts dismissal of her appeal of an executive decision of the Board of Commissioners of Tippecanoe County discharging her from her employment as a courthouse custodian. The trial court dismissed Lincolns appeal as not timely filed within the thirty day period specified by IND. CODE 36-2-2-27. Lincoln argues the Boards decision terminating her employment was judicial in nature and not ministerial, and therefore she has the right of appeal under I.C. 36-2-2-27. Lincoln next argues the statute, I.C. 36-2-2-27, is unconstitutionally vague, and that Trial Rules 6(A) and 6(E) should be applied to determine when the statute of limitations begins and ends. Lincoln also argues that the Boards decision was made when she received notice and that her appeal was timely filed. Finally, Lincoln claims notice sent by ordinary mail constitutes a denial of due process so the notice provided was inadequate as a matter of law.
